Service Agreement

We prioritize transparency and trust with our customers. That's why we have a disclaimer in place to clarify the limitations of our content services. This ensures that you have a clear understanding of what to expect and helps us provide accurate information while protecting both our business and you as a valued customer. Your satisfaction and informed decision-making are our top priorities.

What does this mean for me?

Basically, the agreement below covers a few key things to make sure everything goes smoothly with your dumpster rental:

  • You confirm you have the right to rent the dumpster for the property.

  • You agree to pay the agreed-upon fees, including any extra charges for things like going over weight or keeping the dumpster longer.

  • You're responsible for how the dumpster is loaded (evenly, and not overloaded) and where it's placed on your property.

  • You can't put hazardous or prohibited items in the dumpster, like paint, tires, or appliances, and you're responsible for any issues if you do.

  • You're responsible for any damage to the dumpster while it's in your possession, except for normal wear and tear.

  • You need to make sure we can access the dumpster for delivery and pickup.

  • If something in the agreement isn't legally valid, the rest of the agreement still stands.

  • If we don't enforce a rule one time, it doesn't mean we're giving up our right to enforce it in the future.

  • Ultimately, we both want a safe and successful rental experience, and this agreement helps protect both of us.

Service Agreement & Contract

Equipment Rental & Customer Representations:

  • Customer represents and warrants that they are the legal owner of the property, an authorized renter with explicit permission, hold a valid power of attorney for the property owner, or are a licensed contractor/broker legally authorized to act on behalf of the property owner.

  • Customer shall not sublet the rented dumpster under any circumstances.

  • The rental period commences upon delivery of the dumpster, unless a specific alternative arrangement is documented and agreed upon in writing by Hopp’s Rollaway Services LLC.

Charges, Payments, and Financial Responsibilities:

  • Customer agrees to pay Hopp’s Rollaway Services LLC according to the established rate schedule for the services rendered.

  • Customer is responsible for all applicable federal, state, and local taxes, fees, and charges related to the disposal of their waste materials.

  • A valid credit card must be provided and authorized for charges at the time of contract signing. Payment is due at the time of booking. Hopp’s Rollaway Services LLC reserves the right to withhold delivery or pickup until full payment is received.

  • In the event of non-payment or Customer unresponsiveness to payment requests, Hopp’s Rollaway Services LLC reserves the right to pursue all available legal remedies, including referral to a collection agency or legal counsel.

  • Customer is required to maintain a valid credit card with sufficient funds on file throughout the rental period.

  • Customer authorizes Hopp’s Rollaway Services LLC to charge the provided credit card for any and all rental-related expenses, including but not limited to:

    • Extended rental days

    • Exceeding weight limits

    • Additional dumpster swaps

    • Dry run fees ($75)

    • Clean-out fees ($75, plus additional costs for excessive staining)

    • Emergency delivery/pickup ($150)

    • Dumpster relocation fees within the same address ($125)

    • Weight overage fees ($80 per ton in Peoria IL)

  • Use of “smash my trash” or similar equipment is strictly prohibited. Customer will be responsible for the full replacement cost of any damaged dumpsters, including fabrication, painting, and logo application.

  • Cancellation on the day of delivery will result in a charge of 100% of the rental fee.

  • A $35.00 fee will be charged for each credit card denial or returned check.

  • All invoices are subject to a card processing fee of 3.5% plus $0.30 per transaction. ACH payments are accepted.

 

Weight Limitations and Proper Loading:

  • Customer agrees to adhere to the specified weight limit of 2 tons for a 15-yard dumpster.

  • Dumpsters must be evenly loaded, and contents must not exceed the top rim.

  • Exceeding the weight limit will result in an additional charge of $80 per ton.

Dumpster Placement and Property Damage:

  • Customer is solely responsible for selecting a suitable location for the dumpster, ensuring it can support the weight and size of the dumpster and transport vehicle.

  • Hopp’s Rollaway Services LLC shall not be liable for any damage to pavement, road surfaces, lawns, fences, shrubbery, septic systems, private wells, or any other property. Customer assumes all risk of property damage.

 

Pickup Requirements and Accessibility:

  • Debris must not extend above the top rim of the dumpster. The tarp must be able to securely cover the contents. The rear doors must be closed and secured.

  • Customer must ensure unobstructed access to the delivery and pickup site. A $75 dry run fee will be charged for failed pickups due to inaccessibility.

  • Dumpsters must remain unblocked during the rental period.

 

Customer Responsibilities and Liability:

  • Customer is responsible for any loss or damage to the dumpster, excluding normal wear and tear.

  • The use of forklifts, backhoes, or other heavy equipment is strictly prohibited.

  • Customer shall not overload, move, or alter the dumpster.

  • Customer agrees to indemnify, defend, and hold harmless Hopp’s Rollaway Services LLC from any claims, damages, liabilities, or expenses arising from the Customer's use of the dumpster.

 

Prohibited Materials and Content Regulations:

  • Customer is solely responsible for the contents of the dumpster until it is accepted by the disposal facility.

  • Hazardous materials are strictly prohibited. Any prohibited materials will be rejected, and the Customer will be responsible for their removal and disposal.

  • Prohibited items include, but are not limited to:

    • Refrigerators

    • Mattresses

    • Tires

    • Paint cans, lacquers, adhesives, car batteries, medical waste, contaminated soils, household cleaners, oils, fuels, propane tanks, railroad ties, dead animals, and unsealed sticky or smelly items.

  • Customer will be responsible for any costs, fines, or penalties incurred due to the disposal of prohibited materials.

  • Materials may be returned to the customer at the customer’s expense.

 

Permits, Approvals, and Fees:

  • Customer is responsible for obtaining all necessary permits and approvals.

 

Indemnification and Limitation of Liability:

  • Customer agrees to indemnify and hold harmless Hopp’s Rollaway Services LLC from any claims, losses, or expenses.

  • To the fullest extent permitted by law, Hopp’s Rollaway Services LLC shall not be liable for any indirect, incidental, special, consequential, or exemplary damages.

  • Customer waives all claims related to damage to property, pavement, driveways, walkways, fences, and landscaping.

 

Governing Law:

  • This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.

Severability:  

  • If any provision of this Agreement is held to be invalid, illegal, or unenforceable for any reason, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the provision shall be severed from this Agreement. The remaining provisions of this Agreement shall continue in full force and effect as if the invalid, illegal, or unenforceable provision had never been included. The parties agree that a court of competent jurisdiction shall have the authority to reform any such invalid or unenforceable provision to the extent necessary to render it valid and enforceable, consistent with the original intent of the parties.

 

Waiver:

  • No waiver of any breach of any provision of this Agreement shall be deemed a waiver of any subsequent breach of the same or any other provision. No failure or delay by Hopp's Rollaway Services LLC in exercising any right, power, or remedy under this Agreement shall operate as a waiver of such right, power, or remedy. Any waiver granted by Hopp's Rollaway Services LLC must be in writing and signed by an authorized representative of Hopp's Rollaway Services LLC to be effective. A waiver on one occasion shall not be construed as a waiver of any right or remedy on any future occasion.
